Linda Xu is a partner at Russ August & Kabat, where she represents clients in complex intellectual property and commercial litigation. Ms. Xu has significant trial experience including serving as a lead trial counsel. Ms. Xu has litigated in federal district courts throughout the country, California state courts, International Trade Commission, Patent Trial and Appeal Board, Trademark Trial and Appeal Board, and in arbitration.

Ms. Xu has won trials and obtained highly favorable settlement for the clients. Some of Ms. Xu’s recent matters include:

  • Represented a cybersecurity company that obtained an over $150 million jury verdict.
  • Represented a cybersecurity company in a patent infringement suit, with over $2 billion in damages awarded following a bench trial.
  • Represented a threat intelligence company in obtaining an 8-figure settlement during a jury trial in a patent infringement suit.
  • Represented a mobile solutions company in obtaining multi-million dollar settlements in patent infringement suits.
  • Represented a medical device company in a trademark infringement and unfair competition suit and obtained a favorable settlement.
  • Represented a U.S. computer security company in a Section 337 investigation before the International Trade Commission.
  • Defended a world leading chemical company in a Section 337 investigation before the International Trade Commission.
  • Defended a recruiting agency in a trade secret misappropriation litigation.
  • Represented an exercise equipment and media company in successfully defending multiple patent infringement allegations, breach of contract, and false advertising claims.
  • Represented various computer technology and software companies before the Patent Trial and Appeal Board.

Ms. Xu also advises small to medium sized technology companies to protect and exploit their intellectual property. Ms. Xu counsels on issues in intellectual property portfolio management, technology-based transactions, and intellectual property due diligence in connection with various strategic transactions.
