Russ August & Kabat Partner, Ashley R. Yeargan, authored the article “Addressing the Limitations of the Right of Publicity in the World of AI,” which was published in the Daily Journal on October 23, 2023. In the piece, Yeargan argues for the creation of a federal right of publicity and mechanism akin to the DMCA that would allow for the prompt take-down and review of AI-generated videos and songs mimicking the likenesses and voices of celebrities for unauthorized commercial purposes. Peter Tong, who joined Russ August & Kabat as a partner after completing a clerkship with the Honorable Judge Alan D. Albright in the Western District of Texas, will head the office. As Judge Albright’s most experienced former clerk now in private practice, Mr. Tong looks forward to building a local counsel and patent plaintiff contingency practice.
With nearly a decade of patent litigation and prosecution experience, Mr. Tong brings a wealth of unique insight and technological understanding to any patent team. Mr. Tong has represented companies in numerous patent lawsuits and helped a client secure a jury verdict for hundreds of millions of dollars. He has won inter partes review (IPR) proceedings before the USPTO and matters for both plaintiffs and defendants before federal courts. Besides patent litigation, Mr. Tong has also handled cases regarding thefts of trade secrets and breaches of confidentiality.
Opening a Dallas office near the popular Texas venues in Waco and Marshall allows the firm to better serve its clients who frequently litigate there. Now that Delaware requires detailed finance disclosures from plaintiffs, Texas will become more important than ever.
