Russ August & Kabat Partner Bennett A. Bigman‘s article, “Warhol, Prince and the Future of Copyright”, was published in the 10/6/22 issue of the Daily Journal. The article discusses Andy Warhol Foundation v. Goldsmith and the Supreme Court’s review of what qualifies as “transformative” expression under the copyright fair use analysis. The article concludes that courts may face even more difficult questions about whether human expression is needed for protection of original or transformative works as AI-generated content and works created by computer algorithms become more prevalent.
